Additional Terms - Magazine Subscriptions

These Additional Terms govern your purchase from THE of digital and print magazine subscriptions from www.timeshighereducation.com/store (the "THE Store Website") (each a "Magazine Subscription"), and should be read in conjunction with our General Terms.

Please read both these Additional Terms and the General Terms carefully before purchasing a Magazine Subscription. By purchasing a Magazine Subscription, you confirm that you accept the General Terms and these Additional Terms and that you agree to comply with them. You will (and you will also procure that all Users will) comply with these Additional Terms (as amended from time to time). Capitalised terms used but not otherwise defined in these Additional Terms have the meaning given to them in the General Terms.

These Additional Terms and the General Terms (and any additional agreements referred to or contemplated in each of the foregoing) represent the entire agreement between us and you. In the event of a conflict between the General Terms and the Additional Terms, these Additional Terms shall prevail over the General Terms.

Without prejudice to our powers under the General Terms, you agree that we, at our sole discretion, without notice to you, may terminate or amend the General Terms or these Additional Terms at any time.

By placing an order for a Magazine Subscription on the THE Store Website, you warrant that you are (i) legally capable of entering into binding contracts; and (ii) over the age of 18 years. If we reasonably believe that you are not over the age of 18, we reserve the right to cancel your order.

Before you begin to use your Magazine Subscription, you must create an online account at www.timeshighereducation.com. 
Please note that for certain digital Magazine Subscriptions, you may need to download additional applications via online stores, or otherwise acquire the rights to use appropriate reader software, to enable you to access the relevant online content.

If you are purchasing a Magazine Subscription as an individual, unless specifically stated otherwise, the Magazine Subscription will be personal to you. You are granted a non-exclusive, non-transferable right to access the relevant content from the date of the Magazine Subscription. You are not permitted to share your individual subscription account credentials with any other person.

Some of our digital Magazine Subscriptions offered to Institutions limit the number of users that may access the relevant content. You are only permitted to share or provide access to your Magazine Subscription to the number of users that have been agreed with us as part of your Magazine Subscription.

Your order represents an offer to THE to purchase a Magazine Subscription. After placing your order, you will receive an email from us acknowledging receipt of your order.  Please note that this does not mean that your order has been accepted. 

We reserve the right at any time after receipt of your order, up until the first magazine is dispatched or made available to you online, to decline your order for any reason. 

We will confirm acceptance of your order by sending you an email confirming your Magazine Subscription account details and start date. Only at this point has a binding contract been formed between you and us.

The price of each Magazine Subscription will be as quoted on the  THE Store Websites from time to time, except in the case of obvious error. Prices are inclusive of VAT and delivery. Prices are liable to change at any time. In the event the price of your Magazine Subscription changes, we will notify you via email or post. The change in price will take effect either: (i) from the date of your next payment date; or (ii) 28 days from the date we notify you, whichever is later.   

If the THE Store Websites contain incorrect information, or a Magazine Subscription is listed at an incorrect price, due to typographical errors or an error in pricing information, we shall not be under any obligation to fulfill the Magazine Subscription to you at the incorrect price, even after we have accepted your order, if the pricing error was obvious to a reasonable person. If payment has already been taken for the purchase and your Magazine Subscription is cancelled, we shall immediately issue a credit or refund in the amount of the incorrect price.  Alternatively, we will give you the option of reconfirming your order at the correct price.

Payment can be made by credit or debit card, or by direct debit. We will deduct the appropriate amount from your credit or debit card or bank account on the commencement of your Magazine Subscription or shortly thereafter and on every subsequent date payment is due (depending on the payment period you have selected, e.g. quarterly or annually).

By placing an order, you confirm that the credit or debit card that is being used by you, or the direct debit details that you give, are yours (or that you have the permission of the account holder).

Where payments by direct debit have been delayed or disrupted for any reason, you authorise us to deduct the payment from your bank account as soon as is reasonably possible to ensure your Magazine Subscription account is brought up to date.

If we have not received payment within five days after the date payment is due, we may temporarily or permanently suspend your Magazine Subscription and we shall be under no obligation to provide any or all of the services relating to the Magazine Subscription while any payments remain unpaid.

If your Magazine Subscription includes print products, these will be delivered to your nominated address. We will make every effort to deliver print products within 5 days of the relevant publication date of the applicable product(s). However, in certain circumstances deliveries will not arrive within this time period.

When you are ordering a publication for delivery overseas, you may be subject to import duties and taxes, or other charges, which are levied once the package reaches the specified destination. Any additional charges must be borne by you. We have no control over these charges and cannot predict what they may be.

If your Magazine Subscription includes digital products these will be available via your online account at www.timeshighereducation.com shortly after your order has been accepted.

Your Magazine Subscription shall commence on the date we send you an email confirming acceptance of your order and shall continue until terminated in accordance with the below "Terminating your Magazine Subscription" clause.

Discounted Trial

On subscribing for your Magazine Subscription you may receive the option of a discounted "trial period". If a discounted trial period is available and you choose this option, your Discounted Trial will commence on the date we send a confirmation email to you informing you your Discounted Trial has commenced and shall continue for the period specified in the email (the "Discounted Trial").

You agree that unless you cancel your Magazine Subscription before the end of the Discounted Trial, you will automatically subscribe to the applicable Magazine Subscription on an ongoing basis for the amount specified when you signed up.

Either party may terminate the Magazine Subscription at any time by giving the other party notification by telephone of termination. We may also terminate the Magazine Subscription at any time by giving you written notice of termination. Termination will take effect from the date of the notification. If you terminate shortly before the date your next payment is due then you may still be debited for your Magazine Subscription. However, you may be able to claim a refund in accordance with our "Refunds Policy" set out below.

Nothing in the foregoing shall affect your right to cancel your Magazine Subscription during any Discounted Trial that may apply to your Magazine Subscription. However, we reserve the right to limit the number of Discounted Trials taken up by you consecutively if Magazine Subscriptions are cancelled during this Discounted Trial period.

If you have not paid for your Magazine Subscription within 14 days of the due date for payment, in addition to the above termination rights, we are entitled to immediately terminate your Magazine Subscription.

On termination of your Magazine Subscription, if you have subscribed for a digital Magazine Subscription, you will no longer have access to or be permitted to access your Magazine Subscription.

If you terminate your Magazine Subscription by calling us as outlined above, either within 14 days of: (i) the date on which you were sent an email confirming acceptance of your order; or (ii) the date of your latest payment (the "Refund Period"), we will refund you the cost of the last payment you have made in respect of your Magazine Subscription. No refunds are available in respect of digital Magazine Subscriptions sold to Institutions.

After the Refund Period, no refunds will be available and you will only be able to terminate your Magazine Subscription in the manner set out above.
